- Definitions and Interpretation
In these terms, the following definitions apply, unless the context requires otherwise:
- "Villa" refers to the specific real property located at 12058 Santo Stefano Belbo (Cuneo), Italy
- "Rental Period" means the agreed term for which the villa is rented, as specified in the booking confirmation.
- "Parties" refers to both the landlord and the tenant, and "Party" may refer to either of them.
- Reservation and Payment
- 2.1 Booking Process: To request a reservation, the tenant must submit a completed booking form to the landlord. After receiving the booking request, the landlord will confirm the reservation. Depending on the timing of the booking, the landlord will request either a deposit of 30% of the total rental sum or the full rental amount via invoice.
- 2.2 Payment Terms: The balance of the rental sum must be paid no later than 6 weeks before the start of the Rental Period. If the booking is made less than 6 weeks before the start date, full payment is required at the time of booking.
- 2.3 Additional Fees: A cleaning fee of € 500 will be charged. The tourist tax is payable on-site directly to the contact person.
- Cancellation
- 3.1 Cancellation Policy: Cancellations by the tenant must be made in writing (email). The date the landlord receives the cancellation is the date on which the cancellation takes effect.
- 3.2 Refund Policy: For cancellations more than 90 days before the start date, the deposit (30%) will be refunded. For cancellations within 90 days to 6 weeks before the start, the deposit is retained. For cancellations less than 6 weeks before the start, the full rental sum is due.
- Security Deposit
- 4.1 Security Deposit: The security deposit is intended to cover any damages to the villa, the furnishings, or the grounds, as well as any additional costs not included in the rental price. This is paid at the time of your booking and amounts to 1000 euros.
- 4.2 Return: The deposit will be refunded at the end of the Rental Period, provided no damage has been found or extra costs have been incurred.
- Arrival and Departure
- 5.1 Check-in: The tenant can check into the villa from 3:00 PM on the first day of the Rental Period.
- 5.2 Check-out: Upon departure, the tenant must leave the villa before 10:00 AM on the last day of the Rental Period. Late check-outs may incur additional costs.
- Use of the Villa
- 6.1 Capacity: The number of persons staying in the villa must not exceed the number of persons for which the booking was made. Any changes must be agreed upon in advance with the landlord.
- 6.2 Responsibility: The tenant is responsible for the proper and decent use of the villa and all its facilities. Non-compliance may lead the landlord to terminate the rental agreement immediately without refund.
- Liability and Indemnity
7.1 Landlord's Liability: The landlord is not liable for any direct, indirect, incidental, special or consequential damages, losses or injuries suffered by the tenant or any member of their party as a result of or in connection with the use of the villa. This includes, but is not limited to, loss of property, theft, personal injury, death, or any other damage or expenses arising from accidents, delays, cancellations, changes in travel plans, or any other cause.
7.2 Tenant's Indemnity: The tenant indemnifies and holds the landlord, their employees, agents, and representatives completely harmless from and against all claims, demands, liabilities, costs, expenses (including, but not limited to, reasonable attorney fees), damages, and obligations of any kind arising from:
- The use, condition, possession, or rental of the villa by the tenant and their party.
- Any accident, injury, death, or damage to any person or property located within or in the vicinity of the villa, caused by or as a result of acts or omissions of the tenant or any member of their party.
- Any violation by the tenant of local, regional, or national laws or regulations.
- 7.3 Use of the Villa is the tenant's responsibility to use the villa and its facilities in a manner that does not lead to damage, nuisance, or danger. The tenant acknowledges that the use of facilities such as swimming pools, playgrounds, sports equipment, and the like inherently carries risks, and agrees to use such facilities at their own risk.
- 7.4 Pool and Safety The tenant acknowledges that there is no supervision and that swimming is at their own risk. The tenant is responsible for the safety of themselves, their family, and guests, particularly with regards to children or persons who cannot swim.
- Complaints and Disputes
- 8.1 Complaint Procedure: Should any problems or dissatisfaction arise regarding the villa or services during the stay, the tenant must report this immediately to the landlord or their representative, so that an appropriate solution can be sought. Complaints filed after departure may not always be effectively addressed.
- 8.2 Dispute Resolution: If a dispute is not resolved to satisfaction, parties may consider submitting the dispute to an impartial third party for mediation. If mediation does not lead to a resolution, the dispute may be submitted to the competent Italian court.
- Force Majeure
- 9.1 Definition: Force majeure means any circumstance beyond the control of the landlord that wholly or partly prevents the performance of the agreement, including but not limited to natural disasters, wars, strikes, epidemics, pandemics, and government measures.
- 9.2 Consequences: In the event of force majeure, the landlord has the right to terminate the rental agreement without judicial intervention or to change the Rental Period without the tenant having any right to any form of compensation.
- Privacy and Personal Data
- 10.1 Data Processing: Personal data of the tenant, collected during the booking process, will only be used for the execution of the rental agreement, and will not be provided to third parties without the tenant's consent, except where necessary for the execution of the agreement or to comply with legal obligations.
- 10.2 Privacy Policy: The landlord commits to protecting the tenant's privacy and complying with all applicable privacy laws.
- Final Provisions
- 11.1 Changes: Changes to or additions to these general terms and conditions are only valid if they are agreed upon in writing between the landlord and the tenant.
- 11.2 Entirety: These general terms and conditions constitute the entire agreement between the landlord and the tenant with respect to the subject matter hereof and supersede all prior agreements, arrangements, and assumptions.
- 11.3 Applicable Law: This agreement is subject to Italian law. All disputes arising from this agreement or related to this agreement will be exclusively settled by the competent Italian court.
